Terms of Service

1. Who we are

Izzy (izzysend.com) is operated by Joshua Nahason Wijaya, an individual based in Surabaya, Indonesia ("Izzy", "we", "us"). You can reach us at support@izzysend.com.

These terms apply to the Izzy website and service. By creating an account or paying for a plan, you agree to them on behalf of yourself and the business you represent ("you").

2. The service

Izzy is software that sends email sequences from Google Workspace mailboxes you connect, detects replies and bounces, and pauses sending when signals turn bad. Izzy does not provide leads, contact data or email copy.

We're onboarding the first workspaces by hand. Features described on our website may change as the product develops; we'll tell you before we remove a feature you pay for.

3. Your account

• Izzy is for business use. You must be at least 18 and able to agree to these terms for your business.
• Give us accurate information and keep it up to date.
• Keep your login secure. You're responsible for activity in your account.
• We review new accounts before sending is switched on, and we may decline an account. If you already paid, we refund you in full.

4. Plans, billing and taxes

Our order process is run by our online reseller Lemon Squeezy, which is the merchant of record for all our orders. Lemon Squeezy handles payment, billing questions, sales tax and VAT. Their terms also apply to your purchase.

• Plans are priced per workspace: $47 per month, or $470 per year. Each plan includes 10 mailboxes. Extra mailboxes cost $3 per month each.
• Prices are in US dollars. Sales tax or VAT may be added at checkout depending on where you are.
• Subscriptions renew automatically at the end of each period until you cancel.
• If we change our prices, we'll email you at least 30 days before the new price applies. It takes effect from your next renewal.

5. Cancellation and refunds

• Cancel any time from your billing page or by emailing us. You keep access until the end of the period you've paid for, and you won't be charged again.
• 30-day money-back guarantee. If Izzy isn't right for you, email us within 30 days of your first payment, on either the monthly or the yearly plan, and we'll refund that payment in full. No questions asked.
• Renewal payments and extra-mailbox charges are not refundable, except where the law requires it.
• If we decline your account, or close it when you haven't broken these terms, we refund the unused part of your current period.
• Refunds go back to your original payment method through Lemon Squeezy.

6. Acceptable use

Izzy is for business-to-business outreach only. You agree that you will not use Izzy to:

• email consumers, or use lists of consumer email addresses, whether bought, rented or scraped;
• send email that is misleading about who you are, what you offer, or why you're writing, including false headers, sender names or subject lines;
• send phishing, malware, illegal content, or content that harasses or threatens people;
• keep emailing anyone who has asked you to stop, or work around Izzy's suppression list, sending limits or pauses;
• resell or share access to Izzy without our written permission.

Every email you send must make it easy to opt out. Izzy adds a one-click unsubscribe header, and you should also include an opt-out line in the message. You're responsible for where your leads come from and for following the laws that apply to you and to the people you email, such as CAN-SPAM in the United States, GDPR and ePrivacy rules in the EU and UK, CASL in Canada, and Indonesia's Personal Data Protection Law.

We don't accept freight forwarders or customs brokers based in Indonesia as customers.

7. Your Google Workspace account

You may only connect mailboxes that you or your business control. Google's Workspace Acceptable Use Policy and Administrator Program Policies don't allow unsolicited bulk email, and Google decides how to enforce them. Google may limit, suspend or close a mailbox or a whole Workspace account. That risk is yours: we're not responsible for actions Google takes on your account. We recommend sending cold email from a separate domain and Workspace, not the one your business runs on.

An app password gives Izzy full access to that mailbox over IMAP and SMTP. You can revoke it in your Google account at any time, which disconnects the mailbox from Izzy.

8. Your data

You own your leads, your email content and your replies. For personal data about the people you email, you are the controller and we process it only on your instructions, to run the service for you. We'll sign a data processing agreement on request. Our Privacy Policy explains what we collect and how long we keep it.

9. Pausing and closing accounts

Izzy pauses a mailbox automatically when bounces or unsubscribes pass set limits. We may also pause sending, suspend or close your account if you break these terms, if your sending puts other customers or our infrastructure at risk, or if the law requires it. We'll tell you why when we can. You can close your account at any time.

10. No guarantees

We work to keep Izzy running and accurate, but the service is provided "as is". We don't guarantee uninterrupted service, inbox placement, open or reply rates, or business results. Email providers decide where your email lands.

11. Liability

To the extent the law allows, our total liability for any claim relating to Izzy is limited to the amount you paid us in the 12 months before the claim. We're not liable for indirect or consequential losses, lost profits or revenue, lost data, or actions taken by email providers against your accounts.

You agree to cover claims, fines and costs brought against us because of email you sent through Izzy or your breach of these terms.

12. Changes to these terms

We may update these terms. For material changes, we'll email active customers at least 30 days before they take effect. The date at the top shows the latest version.

13. Governing law

These terms are governed by the laws of the Republic of Indonesia. If something goes wrong, email us first and we'll try to sort it out. If we can't, disputes go to the courts of Surabaya, Indonesia.
